WEB5 strives to maintain a high-level of service, and a lot of customers depend on our high standards of quality. The Acceptable Use Policy is available in order to provide a clear understanding of the rules, regulations and restrictions regarding the use of WEB5's services. PLEASE ABIDE BY IT STRICTLY. By using our services, you agree to abide by the Acceptable Use Policy.

  1. We will not provide services for any unacceptable or inappropriate material as determined by WEB5 in its sole discretion, including but not limited to Topsites, IRC Scripts/Bots, Proxy Scripts/Anonymizers, Pirated Software/Warez, Image Hosting Scripts (similar to Photobucket or Tinypic), AutoSurf/PTC/PTS/PPC sites, IP Scanners, Bruteforce Programs/Scripts/Applications, Mail Bombers/Spam Scripts, Banner-Ad services (commercial banner ad rotation), File Dump/Mirror/Leech Scripts (similar to rapidshare,filesonic,megaupload), Commercial Audio and/or Video Streaming (more than three streams), Escrow/Bank Debentures, High-Yield Interest Programs (HYIP) or Related Sites, Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme), Sale of any controlled substance without prior proof of appropriate permit(s), Prime Banks Programs, Lottery Sites, MUDs/RPGs/PPBGs, Hateful/Racist/Harassment oriented sites, Hacker focused sites/archives/programs, Sites promoting illegal activities, Forums and/or websites that distribute or link to warez/pirated/illegal content, Bank Debentures/Bank Debenture Trading Programs, Fraudulent Sites (Including, but not limited to sites listed at aa419.org & escrow-fraud.com), Mailer Pro Hacking, which includes, for example penetrating or attempting to access, without authorization, another computer or network. Port scans, stealth scans, and fraudulent credit card "phishing" techniques are also prohibited.


  2. We will not provide services for hosting of files or other data that infringes on another's copyright or other intellectual property rights.


  3. We will not provide services for spamming, or sending of bulk unsolicited email. We maintain a strict policy on spamming, which includes the sending of unauthorized commercial messages by use of our services, or by maintaining an open SMTP connection. We reserve the right to refuse or terminate service based on reasonable indications that you are engaged in spamming of any sort.


  4. We will not provide services for uploading or linking to any content that violates another's right of publicity or privacy.


  5. We will not provide services for distributing hate speech, or any other content that is obscene, abusing, which could be considered libellous and defamatory.


  6. We will not provide services for hosting, storing, or distributing child pornography. If any such content is found and brought to our attention, the proper law enforcement agencies will be notified.


  7. We will not provide services for hosting large amounts of data not specifically tied ("linked") to your hosting account. WEB5 encourages users looking for file storage/backup solutions to seek other services that specialize in this.


  8. We will not provide services for hosting, storing, or distributing pornographic material. This includes sites that may provide links to adult content elsewhere. In addition, our servers and services may not be used for the propagation, distribution, housing, processing, storing or otherwise handling in any way lewd, obscene, or satanic materials.


  9. We will not provide services to run any type of web spiders or indexers


  10. We will not provide services to run any software that interfaces with an IRC (Internet Relay Chat) network


  11. We will not provide services to run, host, or store any P2P client, tracker, software, server, files, content or application, including bittorrent


  12. We will not provide services to participate in any P2P or file-sharing networks


  13. We will not provide services to run any gaming servers


  14. We will not provide services to run cron entries with intervals of less than 15 minutes


  15. We will not provide services to use the server as a Backup/Storage device


  16. We will not provide services to use the server for File/Data Archival Purposes


  17. We will not provide services to Store over 100,000 files on an account


  18. We will not provide services to constantly create and delete large numbers of files on a regular basis, or cause file system damage


  19. We will not provide services to execute long-running, stand-alone, auto triggered, unattended server-side processes at any point in time on the server. This includes any and all bots or daemons, custom built shell scripts and other scripting languages and softwares.


  20. We will not provide services to use our system resources that include but not limited to memory, cpu, disk, network, and bandwidth capacity, over the specified levels (indicated below) in any consecutive 6 hour period.

    • WEB5 Starter Plan | Resources over 10%+ | No longer than 60 seconds
    • WEB5 Advanced Plan | Resources over 20%+ | No longer than 90 seconds
    • WEB5 Business Plan | Resources over 30%+ | No longer than 120 seconds
    • WEB5 Professional Plan | Resources over 50%+ | No longer than 180 seconds
    • All Plans in Cloud Reseller | Resources over 20%+ per domain | No longer than 90 seconds
    • All Plans in Cloud Windows | Resources over 30%+ | No longer than 120 seconds
    • All Plans in Reseller Cloud Windows | Resources over 30%+ per domain | No longer than 120 seconds
    • All Plans in Cloud Java | Resources over 20%+ | No longer than 90 seconds

  21. We will not provide services to run any MySQL queries longer than 15 seconds. MySQL tables should be indexed appropriately. (Learn More...)


  22. We will not provide services to use excessive resources which in the WEB5's sole discretion result in damage or degradation to the performance, usage, or experience of Servers, other users, other orders, and any of WEB5's services


  23. We will not provide services to store a large number of media files (audio, video, etc.), wherein the limit is at WEB5's sole discretion


Normal Usage Guidelines
 
Unlimited Bandwidth, Disk Usage, Email and FTP accounts and other Unlimited Resources.
 
WEB5 provides Users with bandwidth, disk space and other resources, such as e-mail, mysql databases, and/or file-transfer-protocol ("FTP") accounts, the amount of which is defined in WEB5's web pages describing the package of Services purchased at the time of purchase. In some cases, WEB5 may not establish a specific amount of bandwidth, disk space and other resources, and refer to that as "Unlimited". In all cases, the Services are intended for normal use only, and any activity that results in excessive usage that is inconsistent with normal usage patterns is strictly prohibited. WEB5 reserves the right to suspend, discontinue or delete the accounts of Users whose use of disk space, bandwidth or other resources results in or presents the risk of degradation of service to other customers, regardless of the amount of disk space, bandwidth or other resources included in the User's plan. User agrees that such usage shall not exceed the amounts set by WEB5 for the Services purchased (the "Agreed Usage") and is additionally subject to normal usage guidelines established by WEB5 as in effect from time to time. These allotments are optimized and dedicated towards serving the Content and User's active electronic mail services related solely to User's web hosting account(s) with WEB5.
 
Hosting space is intended for normal use only, and is limited to Web files, active e-mail and content of the hosted Web sites, not for storage (whether of media, e-mails, or other data). Hosting space further may not be used as offsite storage of electronic files, electronic mail or FTP hosts. You are responsible for removing any files, e-mails or other data which do not meet these requirements, and for adhering to any usage requirements or limits allocated to your account(s). Failure to do so may result in removal and deletion of such materials (including without limitation files and e-mails), and/or in discontinuation of your services or account, which actions we may take in our sole discretion.
 
WEB5 may monitor User's use of bandwidth, disk usage and other resources. WEB5, in its sole discretion, shall have the right to take any corrective action if User's utilization of bandwidth, disk usage or other resources exceeds the Agreed Usage, or normal usage by our typical shared hosting customer, resource usage, or is used for other improper storage or usage. Such corrective action may include the assessment of additional charges, disconnection or discontinuance of any and all Services, removal or deletion of User's Web site, User Content, User's electronic mail and e-mail services and/or other materials and services or termination the User's account and of this Agreement, which actions may be taken in WEB5's sole and absolute discretion.
 
 
Unlimited Domains
 
Unlimited domains refers to subdomains, parked domains and add-on domains. In all cases (even those described as “unlimited”), the Services are intended for normal use only, and any activity that results in excessive usage that is inconsistent with normal usage patterns is strictly prohibited. WEB5 reserves the right to suspend, discontinue or delete the accounts of Users whose use of unlimited subdomains, parked domains and add-on domains results in or presents the risk of degradation of service to other customers, regardless of the amount of domains included in the User's plan. User agrees that such usage shall not exceed the amounts set by WEB5 for the Services purchased (the "Agreed Usage") and is additionally subject to normal usage guidelines established by WEB5 as in effect from time to time. These allotments are optimized and dedicated towards serving the Content and User's active electronic mail services related solely to User's web hosting account(s) with WEB5.
 
User is responsible for complying with any usage requirements or limits for bandwidth, disk space or other resources, and monitoring such usage to ensure the Web site does not violate such requirements or exceed normal usage limits, Agreed Usage, or other limits allocated for the account(s) and otherwise complies with this Agreement. WEB5 will use commercially reasonable efforts to e-mail Users who are at or near their utilization limits, but WEB5 does not take responsibility if e-mail notification(s) is not received by the User. WEB5 reserves the right to discontinue service through the beginning of the next month for your account in the event that it exceeds the any such allotment.
 
If WEB5 takes any such corrective action under this section, User shall not be entitled to a refund or credit of any fees paid prior to such action.
 
 
Disproportionate Server Loads

While our shared services are suitable for personal or small business customers, there comes a time for some websites when they are better suited for a larger plan, which allows for more dedicated CPU and memory resources. We reserve the right, in our sole discretion, to discontinue service to any customer with a website or other hosted data that takes up more resources (indicated above in #20) of the server's CPU in any consecutive 6 hour period. This means that if your website is found to be utilizing more resources of the CPU and/or memory of our server, we reserve the right to take your site offline. If this becomes necessary, you can either upgrade your hosting package, or request a pro-rated refund of the amount you have paid in advance for the services. Due to the severity of this, and our ability to act quickly to correct these situations to avoid server issues, we will do everything reasonably feasible to provide you with a warning prior to taking your site offline, but we accept no obligation to do so.


INODES

The use of more than 250,000 inodes on any shared account may potentially result in suspension. Accounts found to be exceeding the 100,000 inode limit will automatically be removed from our backup system to avoid overusage. Every file (a webpage, image file, email, etc) on your account uses up 1 inode. Sites that slightly exceed our inode limits are unlikely to be suspended; however, accounts that constantly create and delete large numbers of files on a regular basis, have hundreds of thousands of files, and cause file system damage will be flagged for permenent suspension. Exceeding 250,000 inodes the cPanel account will be Permanently Suspended (without notice), the restoration fees is $25 USD per cPanel account.
 

However, in accordance with our Terms of Service, we may remove any materials that, in our sole discretion, may be illegal, may subject us to liability, or which may violate this Acceptable Use Policy. WEB5 may cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrongdoing.
 
WEB5 reserves the right to take reasonable preventative or corrective action to ensure that compliance with its Acceptable Use Policy is adhered to by all users of the service. Your violation of this Acceptable Use Policy may result in the suspension or immediate termination of your account or other services WITHOUT ANY PRIOR NOTICE. Acceptance and adherence to the WEB5's Acceptable Use Policy (AUP) is a part of the WEB5's Terms of Service (TOS) to which each user of the service has agreed to.
